The American visa is one of the travel documents most desired by Colombians, especially because of the seductive opportunities that the visa can offer them in American territory: travel, residence, work and even study, to name a few.
The process to obtain the document, however, can be a headache, since between the paperwork and the waiting time to obtain an appointment with the Embassy, a couple of months can pass.
What many do not know is that there is a premium procedure that Colombians, and in general any citizen, can use to expedite the issuance of their visa. This is the Priority Processing Service, a process that is carried out before the United States Citizenship and Immigration Office and is used in some cases of immigration applications.
How do I know if I can apply?
According to the United States Citizenship and Immigration Services (USCIS), “priority processing provides expedited processing” on the following four types of visa forms:
- Form I-129, Petition for Nonimmigrant Worker.
- Form I-140, Petition for Foreign Immigrant Worker.
- Form I-765, Application for Employment Authorization.
- Form I-539, Application to Extend/Change Nonimmigrant Status.
Those who use the Priority Processing Service will considerably shorten the process, since cases are usually attended to in an average time of 15 calendar days, although depending on the category to which it applies, the process can take up to a maximum of 45 calendar days.
According to the USCIS, the 15 calendar days of response are extended a little longer in the following categories:
- 30 calendar days for a Form I-765, for F-1 students seeking OPT or STEM OPT extensions.
- 30 calendar days for Form I-539 applicants requesting a change of status to F-1, F-2, M-1, M-2, J-1, or J-2 nonimmigrant status, once they have complied with all prerequisites, including receipt of biometric data responses.
- 45 calendar days for Form I-140 for E-13 classifications of executives and managers of multinationals, and E-21 for national interest waivers (NIW).
It is important that you keep in mind that the time will begin to run once you submit Form I-907, which is the Request for Priority Processing. From there, and during the corresponding period, the authority will notify you of a notice of approval of your visa, request for evidence, notice of denial, or fraud investigation.
In the event that the request requires additional evidence or response to a notice of intent to deny, Uscis advises that “the priority processing time period of 15, 30 or 45 days will be stopped and restarted.”
“A new priority processing period will begin when we receive a response to the request for evidence or the notification of intent to deny,” the US government agency detailed.
The United States Citizenship and Immigration Services specifies that for your application to be considered “properly completed,” it must have the required signature and payment of the filing fee.
Prices
Below you will find the list of prices you must pay, depending on the form to which you apply:
- USD 2,805 if you are requesting priority processing of Form I-129, in which you request classification E-1, E-2, E-3, H-1B, H-3, L (including L-1 general) , O, P, Q or TN of nonimmigrant.
- USD 1,685 if you are requesting priority processing of Form I-129, in which you request H-2B or R nonimmigrant classification.
- USD 2,805 if you are requesting priority processing of Form I-140, in which you request EB-1, EB-2 or EB-3 immigrant visa classification
- $1,685 if you are requesting priority processing of a Form I-765 with a (c)(3)(A), (c)(3)(B), or (c)(3)(C) eligibility category.
- USD 1,965 if you are requesting priority processing of a Form I-539 in which you request a change of status to an F-1, F-2, M-1, M-2, J-1 or J-2 nonimmigrant.
