We have modified the USCIS Policy Manual to clarify the filing procedure for Form I-360, Petition for Amerasian, Widow, or Special Immigrant, for certain applicants for special immigrant youth (SIJ) classification (or their representatives). If you are an SIJ applicant and you have less than two weeks left until your 21st birthday, you have the option of filing Form I-360 in person at a local USCIS office, rather than mailing it. To request a speed appointment, please contact the USCIS Contact Center. If you are not within two weeks of turning 21, you must submit Form I-360 by mail, following the current filing instructions.
Minors who meet the requirements for SIJ classification must apply before turning 21 years of age. However, many face difficulties in filing on time due to delays in juvenile courts in issuing the necessary judicial decisions, among other circumstances. Allowing SIJ applicants to submit their petition in person provides them with an additional option to ensure we receive their application on time.
This policy was implemented on March 30, 2023 and we have now updated the policy manual to ensure transparency and consistency in the process.
